This privacy policy is provided pursuant to Articles 13 and 14 of Regulation (EU) 2016/679 (“GDPR”) and Legislative Decree 196/2003, as amended by Legislative Decree 101/2018, to those who consult the website of MONT-ELE S.r.l. and interact with the services offered through it.

2. Types of data processed

Browsing data. During their normal operation, the IT systems and software procedures used to run the website acquire certain data whose transmission is implicit in the use of Internet communication protocols (e.g., IP addresses, browser type, operating system, time of the request, pages visited). Such data are used for anonymous statistical purposes and to ensure the proper functioning and security of the website.

Data provided voluntarily by the user. The optional, explicit, and voluntary sending of messages through the contact forms, applications through the “Work with Us” section, or e-mails to the addresses indicated on the website entails the acquisition of the sender's contact data (name, surname, e-mail, telephone, company) and any other personal data included in the communication or in the curriculum vitae.

3. Purpose and legal basis of the processing

• respond to requests for information, quotes, or assistance sent by the user – legal basis: performance of pre-contractual measures at the request of the data subject (art. 6.1.b GDPR);
• evaluate unsolicited applications and received CVs – legal basis: pre-contractual measures (art. 6.1.b GDPR) and, for any special categories of data, art. 9.2.b GDPR;
• ADempiere legal, accounting and tax obligations – legal basis: legal obligation (art. 6.1.c GDPR);
• ensure site security, prevent abuse, and protect the rights of the Data Controller, including in legal proceedings – legal basis: legitimate interest (Art. 6.1.f GDPR);
• process website usage statistics, subject to consent where required – legal basis: consent (Art. 6.1.a GDPR).

4. Processing methods and storage

The data is processed using automated and/or paper-based tools, with logic strictly related to the stated purposes and by adopting appropriate technical and organizational security measures to prevent loss, illicit or incorrect use, and unauthorized access.

The data is stored for the time strictly necessary to achieve the purposes for which it is collected: contact request data for the time necessary to manage the request and any subsequent commercial relationship; resumes for a maximum of 24 months from receipt; data necessary for legal compliance for the periods established by current regulations.

5. Nature of the contribution

Apart from browsing data, the provision of data is optional. However, failure to provide the data marked as mandatory in the forms may make it impossible to process the request.

6. Data recipients

The data may be processed by authorized internal personnel and by third parties performing activities on behalf of the Data Controller acting as Data Processors pursuant to Article 28 of the GDPR (e.g., hosting service providers, site maintenance, IT and email services, consultants). The data is not disseminated. The updated list of Processors is available upon request to the Data Controller.

7. Non-EU data transfer

Some third-party services used by the site (e.g., Google, YouTube, LinkedIn) may involve the transfer of data to countries outside the European Economic Area. In such cases, the transfer is based on an adequacy decision by the European Commission (including the EU-US Data Privacy Framework) or on standard contractual clauses approved by the Commission.

8. Rights of the data subject

The data subject may at any time exercise the rights provided for in Articles 15-22 of the GDPR: access to data, rectification, erasure, restriction of processing, data portability, objection to processing, and revocation of any consent previously given, without prejudice to the lawfulness of the processing based on consent before the revocation. The data subject also has the right to lodge a complaint with the Italian Data Protection Authority (www.garanteprivacy.it).

9. Changes to this privacy policy

The Data Controller reserves the right to modify or update this privacy policy. Users are advised to check this page periodically.
